Terms of use:

SIA “Vārpas 1”, registration no. LV44103011066, address: “Leimaņi”, Valka Parish, Valka Municipality, Latvia, LV-4701, hereinafter referred to as the “online shop” – provides the content available on the website and supplies goods/services in accordance with the Terms of Use set out below.

1. General provisions

If a consumer purchases goods or services via a website, then such a mutual agreement is deemed to be a distance contract and is subject to the legal provisions of the Republic of Latvia governing distance contracts, including, but not limited to, the Republic of Latvia’s ‘Consumer Rights Protection Law’, the Regulations of the Cabinet of Ministers of the Republic of Latvia “Regulations on Distance Contracts”, etc.

2. Making purchases

The prices and specifications of the products sold in the online shop are shown next to the products.

To place an order, add the products you wish to purchase to your shopping basket. Fill in all the required fields and select the most suitable delivery method. The total cost of your order, including delivery, will then be displayed on the screen. Proceed to checkout to complete your order.

3. Payment Terms

The currency used on the website is the euro. You can pay for your purchase using the following payment methods, provided by the payment platform makecommerce.lv, Maksekeskus AS:

  • Online banking payments in Latvia: Swedbank, SEB, Citadele and Luminor
  • Payments via Estonian online banking: Swedbank, SEB, Luminor
  • Online banking payments in Lithuania: Swedbank, SEB and Luminor
  • Visa/Mastercard card payments

Please note! When using the online banking payment method, please confirm your order and click on the “Return to the retailer” button.

Personal data required for making payments is transferred to the licensed payment institution Maksekeskus AS.

The contract comes into force upon successful payment into the online shop’s bank account. If, for any reason, it is not possible to fulfil the order, the Buyer will be informed accordingly and the amount paid will be refunded as soon as possible, but no later than 14 days after receipt of the notification.

4. Terms of Delivery

Goods are delivered to the following countries: Latvia, Estonia. Purchased goods are delivered via: free collection from the production facility at “Silkalni 1”, Valka parish, Valka municipality, Latvia, LV-4701, and delivery by SIA “Vārpas 1” road transport. All duties and taxes payable to receive the consignment at its final destination are to be borne by the Buyer. Delivery costs are displayed before the order is confirmed. The purchased goods will be delivered to the address specified by the Buyer within 1–5 working days. In exceptional cases, we reserve the right to dispatch the goods within 45 calendar days, provided we inform the customer accordingly.

5. Right of withdrawal

The buyer has the right to withdraw from the purchase within 14 calendar days of receiving the goods. (Depending on the item, the buyer may not have a statutory right of withdrawal; in such cases, the reason must be clearly stated and explained). The right of withdrawal does not apply if the buyer is a legal entity.

In order to exercise the 14-day right of withdrawal, the goods may only be used for their intended purposes; the consumer is responsible for maintaining the quality and safety of the goods during the period in which the right of withdrawal may be exercised. If the goods are used inappropriately or damaged, if they are treated carelessly during use or the instructions are not followed, or if the original packaging of the goods has been lost, or if the packaging is significantly damaged, the online shop is entitled to reduce the refund amount in line with the reduction in the value of the goods.

To exercise your right of withdrawal, you must submit the withdrawal form, which can be found here: (insert link to the withdrawal form) www.veikals.varpas1.lv, by sending it to the email address info@varpas1.lv within 14 days of receiving the goods. 

The buyer is responsible for the costs of returning the goods, except where the reason for the return is that the goods do not match the order (for example, an incorrect or damaged product).

The Buyer is obliged to return the Goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the online shop. Upon receipt of the returned goods, the online shop shall, without delay but no later than within 14 days, refund all payments received from the buyer in accordance with the Distance Contract.

The Seller is entitled to withhold payment until it has received the Goods from the Buyer or confirmation that the Goods have been returned. If the Buyer has chosen a delivery method other than the cheapest option offered by the online shop, the online shop is under no obligation to reimburse the excess delivery costs.

The online shop shall not be liable for any delay in the performance of its obligations, or for any failure to perform them, or for any other form of non-performance arising from circumstances and obstacles beyond the online shop’s reasonable control.

The online shop reserves the right to refuse to sell goods and to request that the Buyer return them if the price stated on the online shop is significantly lower than the market price due to an error.

6. Consumer rights regarding goods that do not comply with the contract

The online shop is liable for any non-conformity of the goods sold to the Buyer with the terms of the contract, or for any defects that arise within 6 months of the date of delivery of the goods to the customer, or that existed at the time of delivery, provided that such an assumption is not inconsistent with the nature of the goods or the defect. The Buyer must inform the Seller of any non-conformity of the goods without delay, within 2 months of discovering it, i.e. must lodge a complaint. The Buyer may submit a complaint by contacting the online shop or by writing to kristers@varpas1.lv.

The online shop shall not be liable for any defects arising after the goods have been delivered to the Buyer. If the goods purchased have defects for which the Seller is responsible, the Buyer is entitled to request that the defects be rectified or that the goods be replaced with new ones free of charge.

If the goods cannot be repaired or replaced, the Seller shall refund to the Buyer all payments specified in the distance contract. The Seller shall provide a written response to the consumer’s complaint within 15 days.

7. Processing of the buyer’s personal data

The online shop processes only the personal data that the customer has entered when placing an order, such as first name, surname, email address, etc.

The online shop passes on personal data to the transport service provider(s) in order to ensure the delivery of goods.

If you have explicitly consented to receiving our marketing communications, including newsletters, we may contact you from time to time to send you information about our services and the latest offers. For this purpose, we may process the email address you provided when you signed up for marketing communications. You have the option to opt out of marketing communications by notifying us at info@varpas1.lv.

8. Dispute resolution procedure

In matters not covered by these terms and conditions, the Buyer and the Seller undertake to comply with the legislation in force in the Republic of Latvia.

The Parties shall resolve any disputes arising between the Seller and the Buyer through mutual negotiation or correspondence. If the dispute cannot be resolved through negotiation or correspondence, the Parties shall resolve the dispute in a court of the Republic of Latvia, in accordance with the laws of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred for resolution to the Consumer Rights Protection Centre or a court of the Republic of Latvia.

The buyer also has the right to refer the matter to the European Union’s dispute resolution bodies.
